Terms of Service

1. Eligibility

You must be at least 18 years of age to register for an account or use the Platform. By registering you represent and warrant that you meet this requirement. Accounts found to belong to persons under 18 will be terminated immediately.

You must have the legal capacity to enter into a binding contract in your jurisdiction. Use of the Platform is void where prohibited by law.

2. Your Account

2.1 Registration

You must provide accurate, current, and complete information during registration and keep it up to date. Each person may hold only one account. Creating duplicate or impersonation accounts is prohibited.

2.2 Security

You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

2.3 Account types

The Platform offers two account types: Model (to present a portfolio and be discovered by photographers) and Photographer (to find and connect with talent). Misrepresenting your account type is grounds for suspension.

3. User Content

3.1 Ownership

You retain ownership of all photos, text, and other material you upload ("User Content"). By uploading content to the Platform you grant us a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and resize that content solely for the purpose of operating and promoting the Platform.

3.2 Content standards

You agree that your User Content will not:

• Depict nudity, sexually explicit material, or obscene content;
• Infringe any third party's copyright, trademark, or right of publicity;
• Contain images of any person who did not give their explicit consent to appear;
• Include personally identifiable information of others without their consent;
• Promote violence, discrimination, hate speech, or illegal activity;
• Contain malware, spam, or deceptive content.

3.3 Moderation

All uploads are reviewed by our moderation team before appearing publicly. We reserve the right to reject, remove, or request changes to any content at our sole discretion without notice or explanation.

3.4 Your warranties

By uploading content you warrant that you hold all necessary rights to the content and that its publication on the Platform does not violate any applicable law or the rights of any third party.

4. Prohibited Conduct

You agree not to:

• Harass, threaten, or intimidate other users;
• Use the Platform to solicit payment outside of agreed professional arrangements, or to facilitate scams, fraud, or deceptive practices;
• Scrape, crawl, or systematically collect data from the Platform without written permission;
• Attempt to gain unauthorised access to any account, system, or network associated with the Platform;
• Use automated tools (bots, scripts) to create accounts, send messages, or interact with the Platform;
• Interfere with or disrupt the integrity or performance of the Platform;
• Attempt to reverse-engineer, decompile, or disassemble any part of the Platform.

5. Professional Conduct & Bookings

MedellinModeling.com is a discovery platform only. We facilitate connections between models and photographers but are not a party to any booking, contract, payment, or engagement that results from those connections. Any agreement reached between users is solely between those users.

We make no representations regarding the accuracy, safety, or suitability of any user profile, and we do not verify credentials, professional status, or the identity of users beyond email confirmation. You are solely responsible for conducting your own due diligence before entering into any professional or financial arrangement with another user.

6. Our Intellectual Property

The Platform's design, code, trademarks, logos, and all content created by us are our exclusive property or are used under licence. Nothing in these Terms transfers any ownership of Platform IP to you. You may not reproduce, modify, distribute, or create derivative works from any Platform content without our prior written consent.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you acknowledge that you have read and agree to our Privacy Policy.

8. Termination

8.1 By you

You may delete your account at any time by contacting us at [email protected] . Upon deletion, your public profile and photos will be removed. Some information may be retained as required by law or for legitimate business purposes.

8.2 By us

We reserve the right to suspend or terminate any account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, harms other users, or is otherwise objectionable.

8.3 Effect of termination

Upon termination all licences granted to you cease immediately. Provisions that by their nature should survive termination — including Sections 3.1, 6, 9, 10, and 11 — will survive.

9. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any particular outcome from using the Platform, including bookings, professional engagements, or income.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MEDELLINMODELING.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, DATA LOSS, OR REPUTATIONAL HARM — ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD $100).

11. Indemnification

You agree to indemnify, defend, and hold harmless MedellinModeling.com and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or use of the Platform, (b) your User Content, or (c) your violation of these Terms or any applicable law.

12. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association. The arbitration will be conducted in English. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

Class action waiver: you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action.

13. Changes to These Terms

We may update these Terms from time to time. When we do we will revise the "Effective date" at the top of this page and, for material changes, we will provide notice via email or a prominent notice on the Platform. Your continued use of the Platform after any change constitutes your acceptance of the new Terms.

14. Miscellaneous

• Entire agreement. These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Platform.
• Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.
• Waiver. Our failure to enforce any right or provision is not a waiver of that right.
• Assignment. You may not assign your rights under these Terms. We may assign ours without restriction.
• Force majeure. We will not be liable for delays or failures caused by events beyond our reasonable control.
